Prof. Irene Kull
Description of the Course:
1) the structure of the legal system in the United States
2) some provisions of the US Constitution
3) techniques of advocacy that a lawyer needs in order to argue to a tribunal
During the course, a number of actual cases that Mr. Ian Neale has worked on or he is currently working on, will be studied in order to learn concepts related to the conduct of litigation.
Additionally Mr. Neale will provide to each student pleadings, disclosure statements and excerpts from actual depositions from a wrongful death case (the Yazzie case) that he is currently defending on the Navajo Indian Reservation. The class will spend some considerable time learning this case and discussing it from the point of view of both plaintiff and defendant. Once students have done that they will be divided into groups of two, with one student representing the plaintiff and the other representing the defendant. Students will be taught how to make a closing or final argument in the case. At the end of the course, all students will be provided a chance of arguing the actual case as if they were in court.
All materials including the case study package for the Yazzie case will be provided on flash drives on the first day of class.
