The Faculty of Law of the University of Tartu is pleased to invite you to the international seminar "The regulatory framework of the European Insolvency Regulation (EU) 848/2015 - typical problems and practical issues", which will be led by Prof. Dr. Reinhard Bork.
The seminar will take place
on 21 May 2024 in Tartu, in the conference hall of the Supreme Court (Lossi 17) from 10.00 to 15.30 and
on 23 May 2024 in Tallinn, Radisson Collection Hotel (Rävala pst 3), room Seville from 10.00 to 15.30.
The seminar will be led by internationally renowned legal scholar Prof. Reinhard Bork of the University of Hamburg. Anto Kasak, Lecturer in Insolvency Law at the University of Tartu and Attorney at Law, will assist on the issues of Estonian insolvency law. Other renowned Estonian insolvency experts will participate in the discussions.
During the seminar, Prof. Dr. Bork will first give an overview of typical problems in cross-border insolvency and then focus on transactions avoidance law (Art. 16 of the EIR). The second part of the seminar will take the form of a case-based discussion. The discussion will focus in particular on aspects of cross-border insolvency law in Estonia, including case law and topical issues.

Overview about seminar on cross-border insovency issues by prof Bork
The Faculty of Law of the University of Tartu was honoured to host Prof. Dr. Reinhard Bork from Hamburg University to lead a seminar entitled "The regulatory framework of the European Insolvency Regulation (EU) 848/2015 - typical problems and practical issues". The first seminar was held in Tartu on May 21st, 2024, and the second seminar took place in Tallinn on May 23rd, 2024.
The seminar primarily consisted of a lecture by Prof. Bork about common problems in cross-border insolvency. The second part of the seminar focused on case law on transactions avoidance (Art. 7(2)(m) and Art. 16 of the EIR). The lecture prompted numerous questions and a lively discussion about cross-border insolvency issues, including, but not limited to, principles of cross-border insolvency, the opening of main proceedings, determination of COMI, secondary proceedings, rights in rem (Art. 8 of EIR), forum shopping, and, obviously, transaction avoidance.
The seminar would not have been possible without a proper audience representing all fields of insolvency law practitioners and academics.
