Erikursus: „United States Criminal Law and Procedure“

Karistusõiguse Jutla kutsub inglisekeelsele erikursusele, mis käsitleb USA kriminaalõigust ja -menetlust ning seda õpetab California pensioneerunud prokurör Patrick J. McKinley, käsitledes teemasid alates eeluurimisest kuni süüdistuste esitamiseni; kohtueelsete taotluste, vandekohtu, karistuse mõistmise ja katseaja määramise, California kolme hoiatuse seaduse, surmanuhtluse ja paljude muude küsimusteni.

Viie päeva jooksul (teemade loetelu päevade lõikes on allolevas programmis) arutletakse klassiruumis arvukate eluliste kriminaalasjade üle, et illustreerida järgmisi õiguslikke küsimusi ja probleeme:

  • välistamisreegel, mis takistab ebaseaduslikult ära võetud tõendite kasutamist süüdistatava vastu,
  • vahistamise ja läbiotsimise probleemid, mis võivad tekkida eeluurimise, vahistamise ja kriminaalsüüdistuse arutamise käigus USA vandekohtu ees,
  • vahistamist käsitlevad seadused, vahistamis- ja läbiotsimismäärused,
  • ütluste andmise pädevus,
  • abikaasade privileeg,
  • ekspertiis, mis puudutab mh verd, DNA-d ja jälgi,
  • kuulus Miranda otsus, mis käsitleb enese mittesüüdistamise privileegi.

June 1 Jury Trials and Jury Selection; Challenges to Jurors based on Race, Gender, Sexual Orientation, etc.; Direct and Cross-examination; Closing Argument; The Insanity Defense; Entrapment and Double Jeopardy; Sentencing and Probation. Vandekohus ja selle valimine; vandekohtunikuks määramise vaidlustamine rassi, soo, seksuaalse sättumuse jne alusel; ristküsitlus; lõpuvaidlused; süüdimatuse kaitse; süüteo toimepanemisele lubamatu ahvatlemine õiguskaitse organite poolt ja topeltkaristamise keeld; karistuse mõistmine ja tingimisi vangistus. 
June 2 Californias 2 and 3 Strike Law; The Hearsay Rule and its Exceptions; The Death Penalty in California; Appeal and Habeus Corpus; The Brady case; Victim and Witness Assistance Programs. The last item in the final class will be a rendition of an “Opening Statement” in a murder case. This is the first thing that happens in an actual trial, but the selected case (a real one) has numerous legal issues in it that will have been discussed in the first four days. During all five days, numerous PowerPoint presentations from real cases will be presented to help illustrate the discussed legal issues.

This course describes US Criminal Law and Procedure, taught by a veteran California prosecutor. Numerous real criminal cases will be presented to illustrate many legal issues in the class. These include the Exclusionary Rule, which prevents evidence that is illegally seized from being used against the defendant, and the numerous arrest and search issues that can occur in the course of investigating, arresting, and prosecuting criminal defendants to an American jury.

These include the laws of arrest, arrest and search warrants, competency to testify, the Spousal privilege, expert witnesses regarding blood, DNA, trace evidence, etc., as well as the famous Miranda decision regarding the privilege against self-incrimination. From the investigation of a case, to the filing of charges, to pre-trial motions, jury trials, sentencing, probation, California's three Strikes Law, the Death Penalty and many other issues.

Due to our continental European background, we are used to taking for granted what happens in our courtrooms and taking what we see in the US movies at face value.

Rarely comes to us as an event during which it is explained how Anglo-American criminal procedure really works. This spring, we can hear it from retired Assistant District Attorney Patrick J. McKinley from  Santa Barbara, California.

The course will cover many different aspects of  US criminal law and procedure, including the filing of charges, pre-trial litigation about the legality of the arrest or search (the US has the "exclusionary rule" preventing illegally seized evidence form being admissible), jury trials, sentencing and appeals.  

Abundant illustrative material from real cases will be presented. In addition to the legal issues, the participant will also learn and see a lot about life (alcoholdrugsdomestic violence/ mental illness etc.), as the cases that are presented are real, with real victims with a name, not a letter like A and B did this, C and D did that etc. The student will see that what they are studying about at The University of Tartu...are real!

Kursus toimub Tartus, Jakobi 2 ringiauditooriumis (ruum 226)  29. maist 2. juunini 2023, iga päev kell 14.15-17.45.

Iga päeva jooksul käsitletakse erinevaid teemasid, mis on programmis välja toodud. Kursus toimub inglise keeles.


Osaleda on võimalik nii kogu viiepäevasel kursusel kui ka üksikute päevade kaupa.

Üksiku päeva osalemise tasu on 90 eurot (hinnale ei lisandu käibemaks).
Kogu kursuse (viis päeva) osalustasu on 300 eurot (hinnale ei lisandu käibemaks). 

Terve kursuse läbimise korral (5 päeva) väljastame kursuse läbimise kohta Tartu Ülikooli täienduskoolituse tõendi ja on võimalik saada 3 EAP.

Patrick McKinley

Patrick J. McKinley attended Duquesne University School of Law in Pittsburgh, Pennsylvania.
Following the passing of the State of California bar exam he began work as a prosecuting attorney in Kern County, California in 1969.

In 1970 he was hired as a Deputy District Attorney in Santa Barbara County, and in 1982 was appointed the Assistant District Attorney, a position he held until his retirement in 2008.

During his 39years Mr. McKinley prosecuted numerous murder, robbery, burglary, theft, rape and child abuse cases, and tried 330 jury trials to verdict.

He participated in the longest criminal investigation in the history of the County of Santa Barbara, the 1987-1993 investigation and  successful prosecution of three individuals for a double murder, including an arrest of the perpetrators in the State of Israel and the extradition of the third defendant from Canada.

Since his retirement has been teaching, in English, about United States criminal law - including numerous teaching trips to Germany alone, as well as many other countries including The Netherlands, Sweden, Austria, Poland, Hungary, Slovakia, Israel, China, and others.

He lives with his wife Esther in Santa Barbara.
